Bastion End User License Agreement

This End User License Agreement ("EULA") governs installation and use of the Bastion Windows launcher and Discord bot software (together, the "Software"). It is between BVNGER and the person or organization that installs or operates the Software ("you"). A Discord server member who only interacts with Bastion inside Discord does not need a Software license; the Bastion Terms of Service address those interactions.
Please read this EULA before installing or completing setup. By accepting it in the Setup Assistant, installing, or using the Software, you agree to it. If you do not agree, do not install or use the Software.
1. Editions and license grant
Public Edition. Subject to this EULA and any applicable beta invitation or purchase record, BVNGER grants you a limited, nonexclusive, nontransferable license to install and run Bastion on one active Windows installation per license for your own Discord server administration. The license is tied to an installation, not to a Discord server. Bastion currently connects to one configured server at a time; this technical limit does not turn the license into a per-server license.
Owner Edition. The Owner Edition includes private development and diagnostic tools. It is reserved for BVNGER's own use and for anyone BVNGER expressly authorizes in writing. Possession of an Owner Edition copy does not grant a customer a right to redistribute or use those tools.
Private beta and complimentary access. If BVNGER provides Bastion without charge for testing, your invitation or written authorization defines the beta period and any specific limits. Beta access does not create a paid subscription, promise continued access, or entitle you to a future paid plan.
You may make copies reasonably needed to install, run, and back up your authorized copy, subject to applicable law. You may not use one license for simultaneous installations on multiple Windows computers or virtual machines. If replacing a computer or reinstalling Windows, stop using the old installation when possible and contact us if you need help moving the license after a hardware failure.
2. Future monthly subscriptions
Bastion does not currently charge through the Software or automatically verify paid subscriptions. The Owner Edition can issue manual keys through a locally run licensing API for testing and individually authorized access; issuing a key does not charge a customer, prove a purchase, or begin automatic renewal. The planned standard paid offer is $5 USD per month for one active Windows installation. BVNGER may manually issue a key with a different stated price and term. Before paid subscriptions launch, the checkout or order record must state the actual price, renewal terms, payment channel, cancellation method, taxes or fees, and any trial or refund terms before you agree to a charge. No payment or automatic renewal is created merely by accepting this EULA.
If a purchase is made through Discord, Discord's applicable purchase terms and controls govern that transaction. If a purchase is made through another approved channel, its disclosed checkout terms govern billing and cancellation. A subscription's cancellation will stop future renewal according to the purchase channel's terms; access already paid for and any refund rights will be determined by those terms and applicable law. We will update this EULA and the Privacy Policy before introducing license activation or a hosted entitlement service.
3. Your responsibilities
You must have authority to administer the Discord server and to supply the bot token and permissions used by Bastion. Keep the token, Windows account, computer, backups, and any future license credentials secure. Configure staff access and moderation features lawfully, give members required notices, and honor applicable privacy requests for records you control. Review destructive actions and maintain your own backups. Discord's terms and platform rules continue to apply to use of its services.
4. Restrictions
Except as expressly permitted by this EULA or applicable law, you may not redistribute, resell, sublicense, rent, or host copies of the Software for others; remove ownership notices; share a license across active installations; or bypass a future license check. You may not use Bastion to scrape or sell Discord data, evade Discord safeguards, or violate law or third-party rights. This section does not prevent activity that applicable law expressly permits despite a contractual restriction.
5. Ownership and your data
The Software is licensed, not sold. BVNGER and its licensors retain rights in Bastion's code, design, brand, and documentation. This EULA does not transfer ownership of your Discord server, your configuration, member content, or locally stored records to BVNGER. The Bastion Privacy Policy explains the current Software's data practices. The present version does not automatically send local server records to BVNGER for license verification.
6. Updates, availability, and license expiration
Bastion relies on your computer, network, Discord, and required permissions. We may provide fixes and new versions, but do not promise continuous operation or a particular update schedule. A later paid release may require a current subscription for licensed management features; the Public Edition does not currently enforce a license check.
If a future subscription expires or an entitlement service is unavailable, BVNGER does not gain ownership of your local data. Any future license controls must leave you a practical way to access and export locally held records and backups and to stop the bot safely. The exact grace period and feature behavior will be disclosed before paid activation begins.
7. Ending the license
You may end use at any time by stopping Bastion, removing its Discord access, and uninstalling the Software. Ending use does not itself cancel a future paid subscription; use the cancellation method supplied by the purchase channel. It also does not automatically delete local files, exports, backups, or Discord log messages, which you must review separately.
BVNGER may terminate this license for a material breach of this EULA after giving notice and a reasonable opportunity to fix the breach when appropriate. We may act sooner if necessary to address security, unlawful use, or platform enforcement. On termination, stop using the Software and remove unauthorized copies, subject to nonwaivable legal rights and any applicable record-retention duties. Ownership, restrictions, disclaimers, liability limits, and dispute provisions survive termination where their purpose requires it.
8. Warranty and liability
To the extent permitted by law, Bastion is provided "as is" and "as available." BVNGER does not promise uninterrupted Discord connectivity, error-free moderation, or recovery of deleted server content. You remain responsible for reviewing permissions and actions taken through your installation. This EULA does not exclude warranties or consumer rights that cannot legally be excluded.
To the extent permitted by law, BVNGER is not liable for indirect, incidental, special, consequential, or punitive losses, or for lost data, profits, or business opportunities resulting from the Software. This does not limit liability that cannot lawfully be limited. Any additional direct-damages cap for a paid plan must be stated in its reviewed purchase terms; no such cap is set by this EULA for the current version.
9. Other terms and changes
The Bastion Terms of Service govern use of Bastion's Discord features and server-member interactions. This EULA governs your license to install and run the Software. A future purchase record governs its disclosed price, billing, renewal, and cancellation terms. If these documents conflict, the more specific term governs its subject, subject to mandatory law.
Iowa, United States law governs this EULA, without overriding mandatory protections that apply where you live. Contact us first at legal@bvnger.dev about a dispute. Courts with jurisdiction under applicable law may hear unresolved disputes. We may update this EULA for future releases; material changes will be presented before they apply where required by law. Continued use after a validly notified update takes effect indicates acceptance, unless applicable law requires a different form of consent.
